Respondent Petition under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondent to disburse the service benefits, including the names of the petitioner's wife, Mrs.Alamelu, and children Minor Sangeevi Moorthy and Minor Sowmiya, as the dependants in the service register. O R D E R
The petitioner was employed as a Driver in the respondent Corporation and had retired from service on 30.06.2013. His grievance is that he has not been settled the retirement benefits and his request for registration of the names of his wife and children in the place of his first wife, who was divorced by him, was not acted upon by the respondent.
2. Non-payment of terminal benefits that too for a longer period is violative of Article 21 of the Constitution of India.
3. Hence, I direct the respondent to settle the terminal benefits, including Pension, DCRC, Encashment of Leave etc., to the petitioner within a period of eight weeks from the date of receipt of a copy of this order, if the same are not settled so far. As for the grievance relating to entering of nomination of his wife and children in the place of first wife in the service register, the respondent is directed to pass appropriate orders on the representation of the https://hcservices.ecourts.gov.in/hcservices/
petitioner, dated 18.02.2014, within a period of eight weeks from the date of receipt of a copy of this order.
4. Writ Petition is disposed of in the above terms. No costs.
