Application No.3796 of 2019 in C.S.Diary No.52273 of 2019 KRISHNAN RAMASAMY, J., The present Application has been filed seeking to dispense with the 80 CPC notice as the applicant requires urgent orders in the suit. 2.1. The learned counsel appearing for the applicant submitted that since the respondents did not act in accordance with G.O.Ms.No.296, Finance (Salaries) Department, dated 09.10.2017, the applicant did the calculations and sent the same to the respondents 2 & 3 but they informed the applicant that the first respondent is the sanctioning authority so that they could only execute the orders of the first respondent.
2.2. He further submitted that the applicant sent three Letters dated 21.08.2017, 26.10.2018 & 12.12.2018 respectively to the respondents and the respondents are also aware of the same. Therefore, the learned counsel would further submit that the aforesaid Letters sent by the applicant may be treated as sufficient notices in order to comply with the Section 80 C.P.C.
3. Having been satisfied with the submissions made by the applicant's counsel and also the reasons stated in the affidavit filed in support of the Application, this Application is ordered as prayed for. 11.06.2019 mrr
