Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the respondent to consider the representation of the petitioner dated 27.03.2019 and to issue the legal heir certificate to the petitioner.

Mr.E.Balamurugan, learned Special Government Pleader takes notice for the respondent. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. The petitioner seeks for a mandamus directing the respondent to consider his representation dated 27.03.2019, wherein and whereby, he sought for issuance of legal heir certificate.

3. It is stated that the petitioner's father died on 13.02.1975 and his mother died on 21.05.1976. It is further stated that one of the petitioner's brothers namely A.David Sundaramony, an unmarried person, died on 20.02.2019. Hence, the petitioner sent the application to the respondent through registered post on 27.03.2019 seeking for issuance of legal heir certificate for his deceased brother namely, A.David Sundaramony. However, the respondent has not taken any action. Hence, the present writ petition.

4. Heard both sides.

5. This Court at this stage is not expressing any view on the merits of the claim made by the petitioner, as it is for the respondent to consider and decide the same. Thus, this writ petition is disposed of, only by directing the respondent to consider the application of the petitioner dated 27.03.2019 and pass orders on the same on merits and in accordance with law, after hearing the petitioner and other interested parties, if any. Such exercise shall be done by the respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
