This Writ Petition has been filed Under Article 226 of Constitution of India to issue Writ of Mandamus or any other in the nature of Writ directing the respondent authority to give permission to conduct Cultural programme (Adal Padal Nigalchi) in the event of Ellaitkuttaiyur Village Arulmigu Sree Sakthi Mariamman Temple Festival at Mettur Taluk, Salem District on 13.05.2022 between 06.00 p.m to 11.00 p.m by considering the petitioner's representation dated 22.04.2022. For Petitioner : Mr.C.Nandhakumar For Respondent : Mr.R.Murthi Government Advocate (Crl.Side) O R D E R The writ petition is filed seeking for a direction to direct the respondent police to consider the representation made by the petitioner on 22.04.2022.

2.When the matter came up before this Court for consideration on 05.05.2022, this Court had directed the respondent police to consider the representation of the petitioner dated 22.04.2022 and pass appropriate order. Though the respondent police passed the order on 05.05.2022, the order reflects that the order was prepared on 01.05.2022 and served on the petitioner on 01.05.2022. The respondent police have refused to grant permission to conduct the Cultural programme https://hcservices.ecourts.gov.in/hcservices/

(Adal Padal Nigalchi) in the event of Ellaitkuttaiyur Village Arulmigu Sree Sakthi Mariamman Temple Festival at Mettur Taluk, Salem District on 13.05.2022.

3.The reasons for not granting permission to conduct the programme is justifiable since the Board Examinations of X and XII standards have commenced, conducting of temple festival at this stage, would not be appropriate as the students would deviate their concentration from studies and they will actively participate in the festival and which will definitely disturb their studies, this Court is not inclined to allow this writ petition.

4.After completion of board examinations, the petitioner is at liberty to give a fresh representation to the respondent police on fixing a new date for conducting the festival. The petitioner is directed to give his representation fifteen (15) days prior to the date of festival. On receipt of such representation, the respondent police shall consider their representation to conduct the festival seven (7) days prior to the date of festival.

5.This writ petition stands dismissed accordingly. No costs.
