ORDER : The Court Made the following order :- The petitioners herein, who were arrested on 13.04.2022 for the offences punishable under Sections 294(b), 353 & 328 of IPC and Sections 7 & 20(2) of Cigarette and Other Tobacco Products Acts, in Crime No.105 of 2022, on the file of the respondent police, seek bail.

2. The case of the prosecution is that petitioners herein was involved in illegal transportation of banned tobacco products in their four four-wheeler vehicles Viz. Eicher Lorry, TATA ACE, DOSTH and TATA ACE.

3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and they had not committed any such offences as alleged by the prosecution. He further submitted that they had been falsely implicated in this case. Hence, he pleads for granting bail.

4. The learned Additional Public Prosecutor appearing for the respondent raised objection for granting bail to the petitioners stating that the petitioners had illegally transported banned tobacco products in their four four-wheeler vehicles, worth about Rs.13.00 lakhs.

5. Considering the serious nature of the offence, this Court is not inclined to grant bail to these petitioners and if they released on bail they will repeat the same offence without any fear.
