The petitioner, who was arrested and remanded to judicial custody on 01.03.2024 in connection with Crime No.119 of 2024 registered for the alleged offences punishable under Sections 394 & 397 of IPC, seeks bail.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is no way connected with the offence, whereas, he is suffering incarceration from 01.03.2024. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court, hence he prayed for grant of bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that the petitioner/A2 along with two other accused, had robbed 1 1⁄4 sovereigns of gold thali from one Roselin Mary by assaulting both the de facto complainant and the said Roselin Mary with iron rod. He further submitted that the offence committed by the accused was available in the CCTV footage and the investigation is still pending, therefore, if the accused is released on bail, he may tamper the evidence. https://www.mhc.tn.gov.in/judis

Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side, and taking note of the fact that the investigation is not yet completed and also considering the gravity of the offence committed by the accused, this Court is not inclined to grant bail to the petitioner.
