The petitioner, who was arrested and remanded to judicial custody on 07.01.2024 in connection with Crime No.149 of 2023 registered for the alleged offences punishable under Section 174 Cr.P.C and altered under Sections 302, 201 IPC, seeks bail.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is none other than the husband of the deceased and he is no way connected with the offence. He also submitted that the petitioner is suffering incarceration from 07.01.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court, hence he prayed for grant of bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that the petitioner, who is the husband of the deceased, having affair with some other woman, thereby, there was a dispute between them. He further submitted that due to the dispute, the petitioner had committed murder of his wife and in order to conceal the offence committed by him, he had lodged a false complaint before the respondent Police.

4. He further submitted that the investigation in this case has been completed and the charge sheet has also been filed and it is yet to be numbered, therefore, if he is released on bail at this stage, there is a possibility of him absconding and not available for trial proceedings.

5. Heard the learned counsel appearing on both sides and perused the materials available on record.

6. Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side, and considering the gravity of the offence committed by the accused and also taking note of the fact that the charge sheet has also been filed, this Court is not inclined to grant bail to the petitioner.
