PRAYER: Contempt Petition filed under Section 11 of the Contempt of the Courts Act, 1971 praying to punish the respondents for their willful and deliberate disobedience of the order of this Court passed in W.P.No.20891 of 2019 dated 23.08.2023.

ORDER

Dr.K.Subrahmaniyan, Registrar, Tamil Nadu Agricultural University, Coimbatore and Mr.M.Sankaranarayana, Comptroller, Tamil Nadu Agricultural University, Coimbatore and Mr.V.Dakshinamoorthy, I.A.S., Secretary to the Government, Agriculture and Farmer Welfare Department, Chennai, are present before this Court. 2.The learned Additional Advocate General appearing for the respondents forwarded a communication issued by the 1st respondent / the Registrar, Tamil Nadu Agricultural University, to the petitioner, dated 07.01.2026 in TNAU/W.P.No.20891 of 2019/2025 wherein, it had been stated as follows:

"In compliance with the directions issued by the Hon'ble High Court of Madras in its order dated 23.08.2023 in W.P.No.20891 of 2019, the Tamil Nadu Agricultural University has decided to disburse the pensionary benefits in accordance with the provisions of G.O.Ms.No.408, Finance (Pension) Department, dated 25.08.2009. This compliance is, however, subject to the outcome of the Writ Appeal preferred

before the Hon'ble High Court of Madras in connection with the said Government Order. In this regard, the pension and arrears payable have been duly worked out and are proposed to be disbursed to the petitioner as detailed below: Name of the employee Pension & Dearness allowance (Rs.) DCRG (Rs.) Total arrear to paid (Rs.) Th.J.Krishnamoorthy 12,37,808 12,39,284 Regular pension from 01.01.2026 is Rs.12,993/-. Therefore, you are hereby requested to contact the Professor and Head, Horticultural Research Station, Udagamandalam, The Nilgiris and the Comptroller, Tamil Nadu Agricultural University, Coimbatore, in person, along with the relevant particulars (i.e. as specified in the affidavit filed by you), for the final settlement of the pensionary benefits. The compliance order will applicable to Th.J.Krishnamoorthy case alone.

sd/- Registrar 3.The learned counsel for the petitioner raised an apprehension that the actual amount may not be disbursed and there might be some delay in disbursal of the amount.

4.But however, let the petitioner appear before the Professor and Head, Horticultural Research Station, Udagamandalam, Nilgiris and the Comptroller, Tamil Nadu Agricultural University, Coimbatore and a direction is given to the 1st respondent / the Registrar, Tamil Nadu Agricultural University, Coimbatore, to comply with his own communication dated 07.01.2026 in letter and spirit. It is needless to point out, if there is refusal to comply with his own communication, the petitioner can always approach this Court.

5.In view of the above, this Contempt Petition is closed. 6.It is stated that the Writ Appeal is also pending, but however, the compliance is only subject to the Writ Appeal, which of course is only natural and fair.
