The petitioner, who was arrested and remanded to judicial custody on 10.10.2023 in connection with Crime No.478 of 2023 registered for the alleged offences punishable under Sections 294(b), 323, 302 of IPC, seeks bail.
2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is none other than the husband of the deceased's sister-in-law and due to the family dispute, there was a quarrel between the petitioner and the deceased/victim, during which both of them attacked each other and other than that, the petitioner has no motive to commit murder of his relative. He further submitted that the petitioner is suffering incarceration from 10.10.2023 and he is ready to abide by any stringent conditions that may be imposed by this Court, hence he prayed for grant of bail to the petitioner.
3. Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that it is the case where the accused, who is the close relative of the
deceased/victim, on account of the family dispute, has abused and brutally attacked the victim with stone and kicked him over his chest, due to which, he sustained grievous injuries and died on the spot. He further submitted that the investigation in this case is still pending.
4. Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent and perused the materials available on record.
5. Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) that the investigation in this case is still pending and also considering the nature and the gravity of the offence committed by the petitioner, this Court is not inclined to grant bail to the petitioner.
6. Accordingly, the Criminal Original Petition stands dismissed. 17.04.2024 ham
