[ Respondents ] Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified mandamus Calling for the records of the 1st respondent in connection with the impugned order passed in letter No. 09452/ A1/HO/SC/2015 dt. 16.5.2015 and quash the same and direct the 1st respondent to fix the seniority of the petitioner over and above the 2nd respondent and consider her claim for promotion to the Post of Deputy Chief Accounts Officer for the year 2014-15 and promote her as Deputy Chief Accounts Officer and grant her all consequential service and monetary benefits.

O R D E R

The petitioner has come to this Court challenging the impugned order dated 16.05.2015 issued by the Managing Director, Tamil Nadu Water Supply & Drainage Board, the 1st respondent herein and for a further direction to the 1st respondent to fix her seniority over and above the 2nd respondent S.Sundaravadivelu, Accounts Officer.

2. Separate counter affidavits have already been filed by both the 1st and 2nd respondents.

3. When the matter is taken up for hearing, the learned counsel for the petitioner fairly submitted that since the petitioner has retired on attaining the age of superannuation on 31.08.2017 and no junior has been promoted overlooking her claim, nothing survives for adjudication in the writ petition.

4. In view of the above, recording the submission made by the learned counsel for the petitioner, the writ petition stands dismissed as infructuous.

No costs. Connected miscellaneous petition is closed.
