ORDER
This Civil Revision Petition has been filed seeking to set aside the docket order dated 16.02.2026 passed in IA Sr.No.592 of 2026 in COS No. 1 of 2025 on the file of the Learned District Judge, Tirupattur.
2. The learned counsel for the petitioner submits that the petitioner herein has filed IA Sr. No. 592 of 2026 in COS No. 1 of 2025 on the file of the District Judge, Tirupattur, under Order IX Rule 7 read with Order XVIII Rules 2 & 4 and Section 151 of the CPC.
3. The application seeks permission of the Court to participate in the proceedings without filing a written statement, limited to raising pure questions of law, addressing arguments on maintainability, jurisdiction, and limitation, opposing the quantum of relief, interest, and costs, and permitting the defendant to cross-examine the plaintiff's witnesses and advance oral arguments. However, the trial court returned the application, stating that since the petition to set aside the ex-parte order (I.A. No. 2 of 2025) was already dismissed on merits on 13.11.2025, the present petition is not maintainable. Aggrieved by the same, the petitioner has filed this Civil Revision Petition.
4. The learned counsel for the petitioner submits that even though the setaside petition was dismissed, the petitioner is legally entitled to cross-examine the witnesses on limited aspects. However, the trial court failed to entertain the application.
5. Considering the facts of the case, the District Judge, Tirupattur, is directed to take IA Sr. No. 592 of 2026 in COS No. 1 of 2025 on file, number the same, and dispose of it on its merits within a period of two weeks from the date of receipt of a copy of this order. The trial court shall proceed with the main suit, COS No. 1 of 2025, thereafter. Accordingly, this Civil Revision Petition is allowed. No costs. Pending miscellaneous petitions, if any, stand closed.
