O R D E R

The wife in the matrimonial proceedings, has preferred the above Tr.CMP.No.921 of 2017 seeking for transfer of I.D.O.P.No.60 of 2017 filed by the respondent herein from the file of the District Court, Cuddalore, to the file of the District Court, Thanjavur.

2. In the affidavit filed by the petitioner in support of this petition, it is stated that the marriage between the petitioner and the respondent was solemnized on 08.03.2013 and out of the wedlock two children were born to them. Due to dispute between them, the petitioner was forced to leave the matrimonial home and staying in her parents home. The petitioner further states that it would be very difficult for her to travel 150km from Thanjavur to Cuddalure along with her two minor children, and therefore, she seeks transfer of the I.D.O.P.No.60 of 2017 pending on the file of the District Court, Cuddalore, to the file of the District Court, Thanjavur.

3. Though the respondent has served with the notice, there was no representation on 27.02.2018, and even today i.e., 08.03.2018 there is no representation for the respondent. https://hcservices.ecourts.gov.in/hcservices/

4. Considering the above averments made in the affidavit filed in support of this petition, this Court feels it appropriate to withdraw I.D.O.P.No.60 of 2017 pending on the file of the District Court, Cuddalore, and transfer the same to the file of the District Court, Thanjavur.

5. Accordingly, the Transfer Civil Miscellaneous Petition is allowed and I.D.O.P.No.60 of 2017 pending on the file of the District Court, Cuddalore, is withdrawn and transferred to the file of the District Court, Thanjavur. No costs. Consequently, connected miscellaneous petition is closed.
