ORDER

(Order of the Court was made by the Hon'ble Chief Justice) None for respondent Nos.1 and 3, though served. Sri.Dwarakesh Prabhakaran, learned counsel, appears for respondent No.2. As regards respondent No.4, who was otherwise proceeded ex parte in the proceedings before the Commercial Court, we are inclined to proceed with the matter by observing that respondent No.4 has not so far been served.

2. Heard the application for condonation of delay in filing the appeal.

3.Taking into consideration the short delay of 48 days and the cause shown, though the prayer is opposed by learned counsel appearing for respondent No.2, we are inclined to condone the delay.

4. Delay is, accordingly, condoned and application is allowed. List the appeal for admission.
