ORDER
The present Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the 2nd and 3rd respondent authority to disburse the Special Provident Fund, Encashment of Earned Leave and Encashment of Unearned Leave on Private Affairs by disposing the petitioners representation dated 17.04.2025 within such time as may be stipulated by this Court.
2. The case of the petitioner is that he served as a Village Administrative Officer at Athankudi Village, Namakkal District. In the year 2013, the petitioner was placed under suspension and was subsequently, removed from service. Owing to the pendency of disciplinary proceedings, he was not permitted to retire on his scheduled superannuation. Even prior to the initiation of enquiry proceedings, the petitioner had submitted a representation seeking disbursement of gratuity, Special Provident Fund, encashment of earned leave and
encashment of unearned leave on private affairs, however, the same was not considered. Consequently, he filed W.P.No.29281 of 2015, which came to be disposed of by this Court vide order dated 16.09.2015 directing the respondents to consider the petitioner's representation within a period of four weeks. Despite the said direction, no order has been passed. Thereafter, the petitioner submitted a further representation dated 17.04.2025 seeking disbursement of his retirement benefits. Even then, no action was taken by the respondents. Aggrieved by the inaction on the part of the respondents, the present Writ Petition has been filed.
3. The learned Additional Government Pleader appearing for the respondents submitted that the second respondent is the authority competent to pass appropriate orders in the matter.

Considering the facts and circumstances of the case and the submissions made on either side, this Court, without going into the merits of the case, directs the 2nd respondent / Revenue Divisional Officer, Namakkal, to consider the petitioner's representation dated 17.04.2025 seeking disbursement of retirement benefits and to pass appropriate orders, on merits and in
accordance with law, within a period of two (2) months from the date of receipt of a copy of this order.
5. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
