Respondents Prayer:- This Second Appeal is filed under Section 100 of Civil Procedure Code against the judgment and decree dated 14.06.2011 in A.S.No.83 of 2008 on the file of the Additional District & Sessions Judge (FTC II), Coimbatore, confirming the judgment and decree dated 25.07.2005 made in O.S.No.346 of 2000 on the file of the Subordinate Judge, Pollachi.

JUDGMENT

When the second appeal came up for hearing on 13.07.2018, the learned counsel for the appellant submitted that the matter has been settled out of the Court and hence seeks permission of this Court to withdraw the second appeal. He has also made an endorsement to that effect in the Court bundle. The endorsement is extracted hereunder:

"The parties herein have settled the matter out of Court. Hence the appellant may be permitted to withdraw the present appeal."

In view of the submissions made by the learned counsel and the endorsement, the second appeal is dismissed as withdrawn. Consequently connected miscellaneous petition is closed. No costs.
