This petition is filed to condone the delay of 123 days in filing the appeal.

2.Heard the learned counsel for the petitioner.

3.The notice sent to the respondent was refused to be accepted and as such, it was returned unserved. Since it was a case of refusal, the notice sent to the respondent is deemed to have been served.

4.In view of the reasons found mentioned in the affidavit filed in support of the Miscellaneous Petition, the delay is condoned. The Miscellaneous Petition is allowed.
