Respondent Petition filed under Section 11 of the Arbitration and Conciliation Act, 1996, to appoint any Competent Independent Person as an Arbitrator to adjudicate upon the disputes that have arisen between the Petitioner and the Respondent in the Scope, Operation and effect of the contract by a Letter of Award (LoA) of the Respondent dated 01.09.2012 and as provided in the Articles of Agreement dated 20.09.2012.

O R D E R

On hearing the learned counsel for parties, it is agreed that Mr.G.M.Akbar Ali, a retired Judge of this Court, may be appointed as the Sole Arbitrator to enter upon reference and adjudicate the disputes between the parties under the aegis of the Madras High Court Arbitration Centre.

2.I, thus, appoint Mr.Justice G.M.Akbar Ali, a retired Judge of this Court, as the Sole Arbitrator to enter upon the reference and adjudicate the disputes inter se the parties. As requested, the arbitration proceedings will be conducted under the aegis of the Madras High Court Arbitration Centre and the parties will be governed by the Rules of the Centre.

3.The original petition is, accordingly, allowed, leaving the parties to bear their own costs.
