The matter is listed today under the caption "for being mentioned" at the instance of the learned counsel for the petitioners.
2. Learned counsel for the petitioners submitted that the relief sought by the petitioners 3,5, 7 to 12, 16, 18 to 20 and 22 in W.P. No.12864 of 2026 has been withdrawn by the respective petitioners. However, some petitioners ranking have been omitted and therefore, the same needs to be rectified in para 3 and consequently corrections are required in other paragraphs viz., para 9 and
10. Accordingly, he prayed for necessary corrections in the above regard in the said paragraphs.
3. In view of the above submission, para 3, 9 and 10 of the said order shall stand substituted with the following para :-

When the matter is taken up for admission, the learned counsel for the petitioners has produced the letters either undated or dated 31.3.2026 or dated 01.4.2026 given by petitioners 3, 5, 7 to 12, 16 and 18 to 20 and 22 seeking to withdraw their names from the above writ petition. The said submission is recorded. Hence, the writ petition stands dismissed as withdrawn in so far as petitioners 3, 5, 7 to 12, 16 and 18 to 20 and 22 are concerned. 1/14

Hence, this Court issues a direction to respondents 1 and 2 to issue posting orders to all petitioners, except petitioners 3,5, 7 to 12, 16, 18 to 20 and 22 and pay them proper stipend within a period of six weeks from the date of receipt of a copy of this order, failing which, respondents 3 to 9 are directed to release their original certificates and the documents submitted by them at the time of admission to the PG course, within a period of one week thereafter in order to enable them to acquire a job elsewhere.
10. The writ petition stands disposed of with the above directions in respect of other petitioners 1, 2, 4, 6, 13, 14, 15, 17 and 21, 23 and 24 are concerned. No costs. Consequently, the connected WMPs are closed.
4. Except the aforesaid modifications, remaining portion of the order dated 02.04.2026 remain unaltered.
5. Registry is directed to carry out aforesaid corrections and issue fresh order copy to the parties.

ORDER
This is a petition filed by the petitioners seeking a direction to respondents 1 and 2 to in turn direct respondents 3 to 9 to return the original testimonials and other documents furnished at the time of securing the Post Graduate (PG) admission.

2. Heard the learned counsel for the petitioner and the learned Government Advocate accepting notice for respondents 1 and 2. In view of the limited nature of direction this Court proposes to issue, notice to respondents 3 to 9 is dispensed with and the writ petition itself is taken up for final disposal.

When the matter is taken up for admission, the learned counsel for the petitioners has produced the letters either undated or dated 31.3.2026 or dated 01.4.2026 given by petitioners 3, 5, 7 to 12, 16 and 18 to 22 seeking to withdraw their names from the above writ petition. This is recorded. Hence, the writ petition is dismissed in so far as petitioners 3, 5, 7 to 12, 16 and 18 to 22 are concerned.
4. The case of the other petitioners is as follows: They are qualified doctors. They have completed MBBS Degree and secured PG admission in the respective government colleges namely respondents 3 to 9 on merit during the academic year 2022-25. They have also completed the PG course in November 2025. During admission to the PG course, the petitioners were directed to submit their original certificates to the respective colleges, in which, they got admission, as a mandatory pre-condition to secure admission in the colleges. In addition, the petitioners, being nonservice candidates, were also required to sign a bond for a sum of Rs.40 lakhs 9/14
with the undertaking that they would serve the Government of Tamil Nadu for a period not less than two years. Though the petitioners completed the PG course in November 2025, in spite of completion of more than three months, till date, the petitioners were not given the bond posting and instead, the officials in the colleges retained the original testimonials and the documents pertaining to the petitioners stating that the petitioners have not completed the compulsory bond posting for a period of two years. Hence this writ petition.

The learned counsel appearing for the petitioners submitted that though the petitioners before this Court have successfully completed their respective PG course during November 2025, the 2nd respondent has neither conducted counselling for regular bond postings for the petitioners till date nor the colleges, in which, they completed the PG course, returned the original certificates and the documents collected from the petitioners at the time of admission to the respective PG course under the pretext that the petitioners have not completed the compulsory bond period of two years. The petitioners came to know from the newspaper article that there are no vacancies in the State of Tamil Nadu for appointing non-service post graduate doctors. While such being the case, retaining the certificates and the documents of the petitioners and restraining them from acquiring a job in private sector are not sustainable. Hence, it would suffice, if this Court issues a direction to the respondents 3 to 9 10/14
to return the original certificates and the documents of the petitioners so as to enable them to obtain a job in the private sector.

On the contrary, the learned Government Advocate appearing for respondents 1 and 2, on instructions, submitted that, as per the prospectus dated 16.3.2018, the petitioners before this Court are directed to serve the Government of Tamil Nadu for a period of two years from the date of completion of their respective PG course and that their certificates will be released after successful completion of the bond period of two years.
7. This Court has carefully considered the submissions of the learned counsel on either side and perused the materials available on record.
8. Admittedly, the petitioners before this Court have completed their respective PG course during November 2025. Hence, retaining the original certificates/documents submitted by them at the time of admission to the respective college on the ground that they have not completed the two years of service as per the bond without even issuing posting orders is not sustainable. Further, restraining them from acquiring a job elsewhere also cannot be acceded to.

Hence, this Court issues a direction to respondents 1 and 2 to issue posting orders to petitioners 3, 5, 7 to 12, 16 and 18 to 22 and pay them proper stipend within a period of six weeks from the date of receipt of a copy of this order, failing which, respondents 3 to 9 are directed to release their original certificates and the documents submitted by them at the time of admission to the PG course, within a period of one week thereafter in order to enable them to acquire a job elsewhere.
10. In so far as petitioners 3, 5, 7 to 12, 16 and 18 to 22 are concerned, the writ petition is accordingly disposed of. No costs. Consequently, the connected WMPs are closed.
