2. Main writ petition has been filed assailing an 'order dated 31.03.2008 bearing reference x/K/vz; 22158-Mh;-,2-08 made by the second respondent ' (hereinafter 'impugned order' for the sake of convenience) wherein the period of part-time service of the writ petitioner i.e., part time Vocational Instructor from 30.06.1979 to 04.10.1996, has not been taken into account for pensionary benefits. The main writ petition was admitted by this Court on 15.12.2008. Pending writ petition, writ petitioner K.C.Balasubramaniam died and this Court is informed that his date of demise is 08.04.2012. This Court is informed that his legal heirs i.e, his wife, two sons and three daughters are to be substituted in place of the writ petitioner as family pension is being availed.

This Court having perused the affidavit filed in support of captioned WMP, having heard learned counsel for petitioners and having noticed that State counsel submits that this is a matter which is now governed by G.O (Ms) No.194 dated 12.09.2018, this Court is of the view that prayer in the captioned M.SUNDAR.J., https://www.mhc.tn.gov.in/judis/

W.M.P.No.19398 of 2019 in W.P.No.29490 of 2008 gpa writ miscellaneous petition (WMP) is not only innocuous, but imperative for carrying the writ petition to its logical end. Therefore, captioned WMP is ordered as prayed for.

4. To be noted, by a separate order, the main writ petition is being disposed of today and Registry is directed to carry out necessary and consequential amendments in the case file before issuing order copy in captioned WMP as well as writ petition.

Captioned WMP disposed of / ordered with aforementioned directive. There shall be no order as to costs.
