A.No.502 of 2017 in C.S.No.861 of 2014 K.KALYANASUNDARAM, J., This Application is filed to condone the delay of 610 days in filing the written statement by the applicant.

2. The learned counsel for the applicant would submit that the defendant his having office at Saidapet and due to the recent flood, the entire records have been damaged and therefore, the written statement could not be filed in time.

3. On the other hand, the learned counsel for the respondent would submit that the suit has been filed for recovery of a sum of Rs.1,17,76,667/-. Further, according to him, the applicant has not given any acceptable reason for condoning the delay. Hence, he prayed for dismissal of the above application.

4. Considering the nature of the suit and the also the submissions made by the learned counsel on either side, this Court is of the opinion that the delay can be condoned on terms:-

Accordingly, this application to condone the delay of 610 days in filing the written statement is condoned on payment of cost of Rs.50,000/- (Rupees fifty Thousand only) to the School Management Committee (SMC), Govt Girls Higher Sec School, Acharapakkam PO, (Bank Account No.32755345428, IFSC Code No.SBIN0015305, State Bank of India, Acharapakkam-603 301 (Headmaster Cell No.8012505385 ) within two weeks from today.
