Respondents Prayer: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus to consider the petitioners' representations dated 03.03.2017 and 03.06.2017 and thereby consequently direct the respondents to regularise the service of the petitioners on completion of ten years of casual labour services in the respondent department in pursuance to the proceedings of the 3rd respondent dated 15.07.2017. ORDER

The learned counsel for the petitioners fairly submitted although the petitioners are working from 01.08.1991 and 01.06.1993 respectively, if the respondents come forward to give the benefit of regularisation even from today, without even giving arrears of benefit, they are prepared to waive the benefit of arrears.

2. Mr.T.M.Pappiah, learned Special Government Pleader appearing for the respondents, agreeing with the learned counsel https://hcservices.ecourts.gov.in/hcservices/

for the petitioners that there has been an order passed by this Court in W.P.No.9361 of 2017 dated 19.04.2017 covering the similar issue in respect of similarly placed persons working in the same department, sought time to consider the case of the petitioners based on the proposal dated 15.07.2011 given by the third respondent-Executive Engineer, Water Resources Organisation, Kodayar Basin Division, Nagercoil to the Superintending Engineer, Water Resources Organisation, Tamirabarani Basin Division, Tirunelveli.

2. In similar circumstances, this Court in W.P.No.9361/2017 dated 19.04.2017 had granted six weeks time to the respondents to consider the proposal dated 15.07.2011 sent by the third respondent to the Superintendenting Engineer, Water Resources Organisation, Tamirabarani Basin Division, Tirunelveli to regularise the service of the petitioners therein. Since the petitioners in this writ petition are also similarly placed and their names have also been mentioned in the proposal dated 15.07.2011, the respondents are hereby directed to consider the case of the petitioners and pass appropriate orders for regularisation of their services within a period of six weeks from the date of receipt of a copy of this order.
