Respondents PRAYER: Criminal Original Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to pass an order to transfer the investigation of the case in Crime No.157 of 2024 on the file of the 2nd respondent herein viz., Inspector of Police, C4-Rathinagiri Police Station, Coimbatore to Superintendent of Police, CBCID, Coimbatore. O R D E R

This Criminal Original Petition has been filed seeking transfer of the investigation in Crime No.157 of 2024 from the file of the second respondent to the file of the Superintendent of Police, CBCID,

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner lodged a complaint, which was registered as Crime No.157 of 2024 for the offences under Sections 420, 421, 506(2) of IPC and Sections 3 & 4 of the Prohibition of Charging Exorbitant Interest Act 2003. However, after registration of the FIR, the second respondent simply kept the FIR pending without taking any further action.

4. On instructions, the learned Government Advocate (Crl.Side) for the respondents submitted that after registration of the FIR, the second respondent proceeded with the investigation, which is now about to complete. At this stage, transferring the investigation from the

file of the second respondent to any other investigating agency would affect the entire investigation already done by the second respondent.

5. In view of the above, this Court is not inclined to transfer the investigation in Crime No.157 of 2024 from the file of the second respondent to any other investigating agency. However, the second respondent is directed to complete the investigation and file final report within a period of twelve (12) from the date of receipt of a copy of this order.

6. With the above direction, this Criminal Original Petition stands disposed of.
