IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED : 11.09.2015
CORAM
THE HON'BLE MR.JUSTICE B.RAJENDRAN Crl.OP No.23006 of 2015 Kannan .. Petitioner Vs
1. The Superintendent of Police Cuddalore District.
2. The Inspector of Police Tittakudi Police Station Cuddalore District.
.. Respondents Prayer:- Criminal Original Petition filed under Section 482 Cr.P.C., to direct the second respondent police not to harass the petitioner by interfering with the civil dispute by calling upon the petitioner for enquiry often, without following due process of law. For Petitioner :Mr.M.Velmurugan For Respondents :Mr.C.Emalias, Additional Public Prosecutor
ORDER
The petitioner has come up with this petition, seeking a direction to the second respondent police not to harass the petitioner under the guise of an enquiry except in a manner known to law.
2. I have heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
3. In my considered opinion, no blanket direction as prayed for by the petitioner could be given. If the petitioner is wanted either for enquiry or for interrogation, he can very well be summoned by the second respondent police and while doing so, the petitioner shall not be harassed. At the same time, the petitioner should submit himself to the second respondent, if summoned, and shall co-operate for interrogation and enquiry. It is made clear that this order will not shield if the petitioner is involved in any cognizable offence.
