JUDGMENT
(Delivered by M.DHANDAPANI, J.) This appeal is filed against the order dated 27.03.2018 passed by this Court in W.P.No.12472 of 2017, wherein the prayer of the appellant herein to quash the RFP Bid Invitation No.1000021222 published on 23.02.2017 to award the license for "Exclusive Advertisement Rights" concession to design, develop and operate and market the advertising opportunity in the entire Airport Estate at Chennai Airport as illegal and unconstitutional, has been rejected, after a detailed consideration of the same.
2.The learned senior counsel appearing for the appellant has submitted that after the dismissal of the writ petition, the tender itself was withdrawn and the bid was cancelled and hence the writ appeal has become infructuous. It is his further submission that liberty may be given to the appellant to challenge the legal issues which have been raised in the writ petition.
3.In view of the above submission made by the learned senior counsel for the appellant, the writ appeal is dismissed as infructuous. If any fresh tender is issued in this connection, it is open to the appellant to raise the legal issues, if any such cause of action arises and if he is so advised, in accordance with law. No costs. Consequently the connected miscellaneous petitions are also dismissed.
