Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the respondents 3 to 6 to remove the encroachments in Old Survey No.430/1 New Survey No.193/1, Classified as Government Poramboke Land situate at Aadhanur South, Pilimisail Village, Alathur Taluk, Perambalur District in Lake Poramboke based on the communication dated 20.12.2023 to the 5th respondent by the 4th respondent in Na.Ka.No.2711/2021 /AA3. ORDER
(Made by the Hon'ble Chief Justice) Heard MrC.Prabakaran, learned counsel for the petitioner, Mr.C.Kathiravan, learned Special Government Pleader for respondent Nos.1 to 3, Mr.Habbeb Rahman, learned counsel for respondent Nos. 4 and 5 and Mr.R.Muniyapparaj, learned Additional Public Prosecutor for respondent No.6.
2. Learned Special Government Pleader submits that the officials would take steps under the provisions of the Tamil Nadu Land Encroachment Act, 1905. The said steps would commence within a period of three months from today.
3. It is made clear that we have not observed anything on the merits of the matter. If notice is issued, the aggrieved person, if any, may file a reply to the said notice and may take all the defences available.
4. The writ petition, accordingly, stands disposed of. There shall be no orders as to costs.
