This is an original petition filed under Section 372 of the Indian Succession Act for an order to issue a Succession Certificate authorising the fifth petitioner to collect the debts and securities shown in the schedule to the Original Petition.

2. The petitioners are the children born to Smt.P.V.Seshambal in her lawful wedlock with Thiru.P.V.Narayanan. Smt.P.V.Seshambal died intestate on 20 October 2008. Her husband pre-deceased her. The petitioners are the Class-I heirs entitled to succeed to the estate of the deceased.

3. The petitioners wanted a Succession Certificate authorising the 5th petitioner to collect the debts and securities shown in the schedule to the Original Petition.

4. The petitioners have taken paper publication in "Makkal Kural" dated 17.07.2015. So far no objection has been received from any one.

5. The 5th petitioner was examined as P.W.1. The following documents were marked through him:- Exhibits Documents Ex.P1 Computer generated death certificate of Tmt.P.V.Seshambal, who died on 20.10.2008 Ex.P2 Photocopy of the legal heir ship certificate of Tmt.P.V.Seshambal dated 19.11.2008 issued by Tahsildar, Purasawalkam - Perambur Taluk Ex.P3 Computer generated death certificate of Thiru.P.V.Narayanan, who died on 17.06.2009 Ex.P4 Photocopy of the legal heir ship certificate of Thiru.P.V.Narayanan, dated 13.10.2009 issued by Tahsildar, Purasawalkam - Perambur Taluk Ex.P5 Series 84 Nos Photocopies of Share Certificates in various companies held by deceased mother P.V.Seshambal and deceased father P.V.Narayanan Ex.P6 Paper Publication effected in Tamil Daily "Makkal Kural"dated 17.07.2015

6. In view of the averments found mentioned in the Original Petition and the documents exhibited, I am of the view that the petitioners are entitled to a Succession Certificate.

7. There shall be a direction to issue a Succession Certificate in the name of the 5th petitioner authorising him to collect the debts and securities shown in the schedule to the Original Petition on behalf of all the petitioners.

In the upshot, I allow the Original Petition. 01.12.2015 svki
