THE HONOURABLE Mrs. JUSTICE PUSHPA SATHYANARAYANA Tr.C.M.P.No.946 of 2017 and C.M.P.No.18910 of 2017 Sheela ... Petitioner Vs Manimaran ... Respondent Transfer Civil Miscellaneous Petition filed under Section 24 of C.P.C. to withdraw O.S.No.66 of 2017 on the file of the Family Court, Puducherry and transfer the same to the Family Court, Chennai.
For Petitioner : Mr.M.Senthilkumaran For Respondent : Mr.D.Senthilkumar
O R D E R
This Transfer Civil Miscellaneous Petition has been filed seeking transfer of O.S.No.66 of 2017 from the file of the Family Court, Puducherry to the file of the Family Court, Chennai.
2.
After filing of the transfer petition, O.P.No.4008 of 2017 filed by the petitioner-wife on the file of the VI Additional Principal Court, Chennai was decreed ex-parte. Learned counsel for the respondent-husband is unable to say as to whether the same is sought to be set aside or not. 3.
As the relief of divorce had already granted by the Family Court, Chennai, the very same relief sought for by the husband in O.S.No.66 of 2017, on the file of the Family Court, Puducherry for dissolution of marriage, will automatically becomes infructuous. Hence, there is no reason to transfer the said O.S.
