Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the fifth respondent to consider the representation of the petitioner dated 16.12.2023 and consequently direct the fifth respondent to issue patta in petitioner's name for 31 cents [12.5 Ares] in Survey No.421 and R.S.No.421/3A in No.28, Perungalathur Village, 1/5

Tambaram Taluk [previously Sriperumbudur Taluk], Chengapattu District [previously Kancheepuram District] and make corrections in the online FMB accordingly.

ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

This writ petition is filed to direct the fifth respondent to consider the representation of the petitioner dated 16.12.2023 and consequently direct the fifth respondent to issue patta in petitioner's name for 31 cents [12.5 Ares] in Survey No.421 and R.S.No.421/3A in No.28, Perungalathur Village, Tambaram Taluk [previously Sriperumbudur Taluk], Chengapattu District [previously Kancheepuram District] and make corrections in the online FMB accordingly.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the materials available on record.

4. The case of the petitioner is that instead of the name of the petitioner, one S.Makkal Anban was included in new patta No.7748 for the survey No.421/3A. The grievance of the petitioner is that though he has given representation to the fifth respondent to rectify the defect, he has not taken any action on the same. Hence, the present Writ Petition.

5. Considering the limited relief sought for in this writ petition, without going into the merits of the case, there shall be a direction to the fifth respondent to consider the representation of the petitioner dated 16.12.2023 and pass Orders on the same on merits and in accordance with law within a period of two months from the date of receipt of a copy of this order.

6. With the above direction, this writ petition is disposed of. No costs. 29.04.2024 vrc 3/5
