Rules read with Order VII Rule 1 of the Civil Procedure Code praying for a judgment and decree a) of specific performance of the written sale agreement dated 15.07.2013 and thereby directing the defendant to execute and register the sale deed in respect of the schedule mentioned property in favour of the plaintiff at the cost of the plaintiff on receipt of the balance sale consideration of Rs.73,00,000/- after obtaining permission from this court failing which this court may be pleased to execute and register necessary sale deed thereof in favour of plaintiff.

b) granting decree of permanent injunction restraining the defendant, its successors in office, administrators and assigns, men and 1/3

agents from in any manner encumbering the suit schedule mentioned property.

c) granting decree of permanent injunction restraining the defendant, its successors in office, administrators and assigns, men and agents from in any manner interfering with the plaintiff's peaceful possession and enjoyment of the plaint schedule mentioned property and d) directing the defendants to pay the plaintiff the cost of the suit. For Plaintiff : No appearance For Defendant : Set Exparte J U D G E M E N T Earlier, when the Suit was posted on 17.12.2024 for hearing, there was no representation for the plaintiff. Hence, the Registry was directed to print the name of the plaintiff in the cause-list and post this matter today under the caption, 'for dismissal' and accordingly, it is listed today.

2. Even today, inspite of the name of the plaintiff being printed in the cause-list, the plaintiff has not chosen to appear before this court. Hence, this Suit is dismissed for non-prosecution. No costs. Gv 18.12.2024 2/3
