Debtor Prayer: Petition filed under Sections 9 to 13 of the Presidency Town Insolvency Act, III of 1909 and Order III Rule (8) of the Insolvency Rules, 1958 to adjudicate the debtor as insolvent and to direct that the estate of the debtors be vested in the Official Assignee of Chennai for the benefit of the body of creditors of the debtors and to order that the cost of this petition be paid by the Official Assignee, Chennai from and out of the estate of the Debtors to the petitioning creditor. An affidavit dated 06.01.2021 has been filed by the respondent/Debtor stating that the entire dues of the petitioning creditor has been settled and the same has also been acknowledged by the Petitioning Creditor. Payments have been made by way of Pay Orders favouring the petitioner.
