This petition has been filed seeking to grant Special Leave to the petitioner to file criminal appeal against the order of acquittal passed by the learned III Additional District and Sessions Judge, Coimbatore in Crl.A.No.226 of 2019 dated 10.11.2022.
2.The learned counsel for the petitioner submitted that the petitioner filed complaint under Section 156(3) of Cr.P.C. for the offence under Sections 120(b), 406, 420 and 506(ii) of I.P.C. on the file of the learned Judicial Magistrate No.II, Coimbatore and the same was registered as Crime No.113 of 2012 and the law enforcing agency after conducting enquiry filed final report as 'mistake of fact' and the objection petition filed by the complainant was treated as complaint under Section 200 of Cr.P.C. and before the trial Court, the case ended in conviction, as against which, the respondent/ accused preferred Crl.A.No.226 of 2019 before the learned III Additional District and Sessions Judge, Coimbatore and the case ended in acquittal.
