Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records relating to the order 17.11.2023 in Roc. No.36200/2023/V1 on the file of respondent and quash the same and consequently direct the respondent to reinstate the petitioner in service with all other benefits by considering his representation dated 19.03.2024. 1/4

ORDER

This Writ Petition has been filed challenging the order of suspension dated 17.11.2023.

2.Heard the learned counsel appearing on either side and perused the materials available on record.

3.Though this Writ Petition has been filed challenging the order of suspension, the same can be reviewed as per the G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022, since it is pending from 17.11.2023.

4.On instructions, the learned Additional Government Pleader appearing for the first respondent submitted that the petitioner was issued with charge memo to initiate criminal proceedings. 2/4

5.In view of the above, the first respondent is directed to consider the representation submitted by the petitioner seeking revocation of the suspension order in the light of the G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022, and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

6.With the above direction, this Writ Petition stands disposed of. Consequently, connected miscellaneous petition is closed.
