O R D E R
( Order of the Court was made by D.KRISHNAKUMAR, J.) Both the appellant and the respondent are present in the Court. Counsel appearing for the parties are also present in the Court. Compromise 1/4
entered into between the appellant and the respondent by way of Joint Compromise Memo signed by the parties as well as counsel appearing for the parties, has been filed before this Court. The terms and conditions of the Joint Compromise memo read over by the parties and both of them aware of the terms and conditions of the Joint Compromise memo.
2. The Joint Compromise memo, entered into between the parties is hereby recorded, wherein the appellant is agreed to pay a sum of Rs.37,00,000/- (Rupees thirty seven lakhs only) through three instalments and he shall pay the 1st instalement of Rs.15,00,000/- (Rupees fifteen lakhs only) on or before 31.5.2023, 2nd instalment of Rs.10,00,000/- (Rupees ten lakhs only) shall be paid on or before 1.8.2023 and the balance of Rs.12,00,000/- (Rupees twelve lakhs only) shall be paid by him on or before 31.12.2023. The respondents have also agreed to the aforesaid terms and to vacate and hand over the complete possession of the flat as stated in the Joint Compromise memo, to the appellant on the date of making the final payment of Rs.12,00,000/- i.e. on or before 31.12.2023.
3. Mr.Anantha Padmanaban, Senior Counsel was nominated as Mediator and in view of amicable settlement between the parties through him, both parties agreed to pay a sum of Rs.50,000/- (Rupees fifty thousand only) each 2/4
to the Mediator as remuneration on or before 30.4.2023 for the service rendered by him. The Joint Compromise memo has been taken on record and the same shall form part and parcel of the order.
4. In view of the above, the appeal stands disposed of. No costs. Registry is directed to list the matter in the first week of December, 2023 for reporting compliance.
