..Respondents Prayer:- Writ petitions filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 2nd respondent to provide electricity service connection to the petitioner's residential house at Rithkshan Illam, Near Kathiresan Police House, J.J.Colony, Vadakku Theru, Dhalavoipattinam Village, Dharapuram Taluk, Tiruppur District by accepting indemnity bond of petitioner and pass such other further orders.

ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the 2nd respondent to provide the electricity connection to the house of the petitioner. 2.

The case of the petitioner is that he is living along with his family in the subject property. Originally, the property was assigned in favour of one Kuppusamy by proceedings dated 31.12.1986. This property is said to have been purchased by the father of the petitioner. The father of the petitioner died on 05.07.2012. ownership over the property. The petitioner made an application seeking for electricity connection. Since the same was not considered, the present writ petition has been filed before this Court seeking for appropriate directions.

Heard the learned counsel appearing for the petitioner and Mr.N.Damodharan, learned counsel appearing on behalf of the respondent.

Taking into consideration the facts and circumstances of the case and the limited relief that has been sought for in this writ petition, there shall be a direction to the 2nd respondent to consider the application submitted by the petitioner on 20.06.2020 and make a physical verification with regard to the occupation of the petitioner and if the petitioner is found to be in occupation of the property, the application shall be processed after receiving the indemnity bond from the petitioner and the service connection shall be effected. This process shall be completed within a period of four weeks from the date of receipt of copy of this order. No costs. -s/d- Assistant Registrar True Copy Sub-Assistant Registrar To
