Small Industries Development Bank Of India (Sidbi) v. Vivriti Capital Private Limited
C.M.P.Nos.9256 and 9260 of 2021 and C.M.P.Nos.9990 and 9992 of 2021 in O.S.A.Nos. SR 50928 & 50929 of 2021 THE HON'BLE CHIEF JUSTICE and SENTHILKUMAR RAMAMOORTHY, J.
(Made by the Hon'ble Chief Justice) The applicant is not a party to the suit but claims to have granted credit facilities to the second respondent in the proposed appeals. The would-be appellant represents the consortium of lenders and submits that it is vitally interested in the matters pertaining to the second respondent and the transactions which form the subject-matter of the suit.
2. Since it, prima facie, appears that the applicant may be a proper party to the suit and may be intrinsically associated with the transactions forming the subject-matter of the suit, leave is given to the applicant to prefer the appeals. However, it will be open to the respondents, particularly the plaintiff, to contend that the applicant herein may not be a person aggrieved or having any interest in the transactions that form the subject-matter of the suit.
3. Further, the applicant seeks leave to dispense with the production of certified copy of the order impugned upon producing a website copy thereof. It is also submitted on behalf of the second respondent in the appeals that it has filed an independent appeal and such appeal should also be taken up along with the non-party's appeals.
The applications for granting leave, C.M.P.Nos.9256 and 9260 of 2021, and the applications for dispensing with the filing of the certified copy, C.M.P.Nos.9990 and 9992 of 2021, are allowed. Let the appeals be allotted appropriate numbers and be listed along with the appeal of the second respondent herein, O.S.A.No.14 of 2021, on 06.07.2021.
