ORDER

The petitioner has come up with this petition for a direction to the respondents to provide police protection for the festival of Consecration of Mariyamman Temple situate at Manjarahalli Village, Pennagaram Taluk, Dharmapuri District on 16.9.2015 and 17.9.2015 based on the representation of the petitioner dated 04.9.2015 forthwith.

2. Learned counsel for the petitioner would contend that the temple festival is being conducted only on the basis of the order dated 21.7.2015 passed by the Revenue Divisional Officer, Dharmapuri. Learned counsel for the petitioner would further contend that based on the said order, the petitioner has submitted a representation dated 04.9.2015 to the respondents seeking police protection but the same was not considered till date.

The learned Additional Public Prosecutor appearing for the respondents police would submit that the Revenue Divisional Officer, in its order dated 21.7.2015, has clearly stated that the petitioner has to get permission from the Revenue Divisional Officer as well as from the police concerned before conducting the festival. It is submitted that if the petitioner approaches the Revenue Divisional Officer and the police, necessary orders will be passed by them.

In view of the above submission made by the learned Additional Public Prosecutor, the petitioner is directed to make fresh representation to the Revenue Divisional Officer as well as to the police concerned and on such representation being made, the Revenue Divisional Officer as well as the respondents herein are directed to consider and pass orders in the manner known to law, preferably within the reasonable time.

5. With the above direction, the Criminal Original Petition is disposed of.
