The instant writ petition has been filed with a prayer for issuing a Certiorarified Mandamus, calling for the records on the file of 1st respondent in Proceedings Ku.A. No. 0038/ U.Se.Po./ EPENagaram/Udu/Ko.Tha.Pa.Nee/2023 dated 13.01.2023 and 2nd respondent in Ku.No.03512/2018 Me./Po/U.Mi.Pa.Va./Udu/Nir/Ka.O.Na./22-23 Dated 29.04.2023, quash the same, consequently, direct the respondents to regularize the period of suspension as duty period by issuing a posting order to the Petitioner with sustenance allowances for the period from 13.01.2023 till the date of issuing a posting order, with all monetary and other consequential service benefits.

2. Though the writ petition was filed challenging the suspension order dated 13.01.2023, the learned counsel for the petitioner would fairly submit that subsequent to the charge memorandum dated 29.04.2023, an enquiry 2/4

was conducted and Disciplinary Authority has passed an order very recently and removed the petitioner from service with effect from the date of his suspension.

3. If that being the case, the instant writ petition challenging the suspension order is not maintainable.

4. In view of the same, the present writ petition is dismissed. No costs.
