2. Heard the learned counsel for the petitioner /appellant.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, this Court is inclined to allow this petition.

Accordingly, this petition is allowed as prayed for.

4. The Registry is directed to carry out the necessary amendment in the second appeal.
