ORDER
The petitioner, who apprehends arrest for the alleged offence under Sections 303(2) of Bharatiya Nyaya Sanhita (BNS), 2023 and 21(1) of Mines & Minerals (Development & Regulation) Act, 1957 in Crime No.6 of 2026, on the file of the respondent police seeks anticipatory bail.
2. The allegation against the petitioner is that the petitioner was involved in illegal transportation of sand without any valid permit or licence and that the petitioner was caught red handed by the respondent police. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner was innocent and that he has been falsely implicated in this case. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and he is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the petitioner has three previous cases pending against him and hence, he opposed to grant anticipatory bail to the petitioner.
5. I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record.

Considering the facts and circumstances of the case and taking into consideration of the nature of the allegation against the petitioner and the fact that the petitioner has got three previous cases pending against them, the conduct of the petitioner in misusing the liberty by involving himself in similar
offence is also a ground against the petitioner in denying bail. Hence, this Court is not inclined to enlarge the petitioner on anticipatory bail.
7. Accordingly, this Criminal Original Petition is dismissed. 07-04-2026 SHL To:
