Petition praying that in the circumstances stated therein the High Court will be pleased to modify the order passed by the Honble High Court in Crl.M.P.No.15277 of 2017 in Crl.A.No.762 of 2017 dated 06.12.2017 and pass such other further order as deem fit and proper in the circumstances of the case and thus render justice. [CRL.MP.NO.15979/2017] Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.P.GANESAN, Advocate for the petitioner and of MR.P.GOVINDARAJAN ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- By order dated 06.12.2017, while suspending the sentence, this Court has passed the following order:- i) the petitioner shall deposit a sum of Rs.1,00,000/- to the credit of Spl.Case.No.
13 of 2012 on the file of the learned Chief Judicial Magistrate/Special Judge, Ariyalur, within a period of three weeks from the date of the receipt of a copy of this order and also ii) the petitioner shall execute a bond for a sum of Rs.
every English calendar month, at 10.30 am, until further orders.
2. Now, the learned counsel for the petitioner submits that the petitioner is not in a position to deposit a sum of Rs.1,00,000/- and hence sought permission of this Court to modify the condition.
3. The learned Additional Public Prosecutor representing the State submits that if the cash security is modified, then the security for bond amount shall be enhanced from Rs.10,000/- to Rs.1,00,000/-.
4. Recording the same, the order passed by this Court on 06.12.2017, is modified with the following condition:- i) the petitioner shall execute a bond for a sum of Rs.1,00,000/-(Rupees One Lakh only) with two sureties each for a like sum to the satisfaction of the learned Chief Judicial Magistrate/Special Judge, Ariyalur, within a period of two weeks from today. At least one of the sureties shall be a blood relative of the petitioner and also iii) the petitioner shall appear before the said Magistrate Court on the first working day of every English calendar month, at 10.30 am, until further orders.
