On considering the pleadings, plaint and the written statement and upon hearing the submissions of the learned counsel on either side, the following additional issues are framed for trial and determination? i. Whether the plaintiff is entitled for a declaration that the sale deed dated 24.01.2020 executed by the 1st defendant in favour of the 3rd defendant registered as Doc.No. 380 of 2020, dated 30.01.2020 on the file of the Sub Registrar Office, Anna Nagar, is null and void and not binding on the plaintiff to the extent of inclusion of a portion of the suit property measuring an extent of 475 Sq.ft out of 3720 Sq.ft and a common passage on its southern side measuring 744 Sqft and also with wrong description of boundaries therein? ii. To what other relief the Plaintiff is entitled to? Affidavit of documents, typed set of papers and list of witnesses are to be filed within two weeks. Post the matter before the Additional Master-IV for recording evidence on 25.03.2024 and after completion of recording evidence, post the matter before this Court.
