ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 11.11.2021 for alleged offence under Sections 8(c) r/w 20(b)(ii)(c),28 and 29 of the NDPS Act, seeks bail.

2. The case of the prosecution is that a truck was intercepted and it was found that it was carrying nearly 360.950 kgs. of Ganja. Four persons were arrested in this regard and the petitioner before this Court has been arrayed as A-4.

3.Heard Mr.A.Mohammed Ismail, learned counsel for the petitioner and Mr.N.P.Kumar, learned Special Public Prosecutor (NCB Cases) for the respondent.

4. In the present case, the contraband that was seized comes under the commercial quantity and hence, the requirements of Section 37 of the NDPS Act has to be strictly complied. https://hcservices.ecourts.gov.in/hcservices/

5. On going through the materials available on record, it is seen that the statement of the accused person has been recorded under Section 67 of the NDPS Act and prima facie, there is no violation of the mandatory provisions under Sections 42 and 57 of the NDPS Act. In view of the above, there are no merits in this bail petition and accordingly, the same is dismissed.
