ORDER

The petitioner seeks a direction to the official respondents to launch criminal prosecution against the respondents 3 to 5 for the alleged impersonation committed by them while presenting a Power of Attorney for registration in the year 2011.

2. Since this Court expressed its view that the relief sought by the petitioner cannot be granted through a writ petition, since it requires a direction to the registration department to cancel the registered document, learned counsel for the petitioner has now made an endorsement in the Court bundle seeking liberty for the petitioner to file a civil suit against the alleged offenders, namely the respondents 3 to 5 and also launch independent criminal prosecution against them.

3. No prejudice would be caused to any of the parties, if such a liberty is granted.

4. Accordingly, this Writ Petition is disposed of by granting liberty to the petitioner to approach the civil court seeking reliefs as prayed for in this writ petition against the respondents 3 to 5 and liberty is also granted to the petitioner to independently launch criminal prosecution against the respondents 3 to 5 without the involvement of the registration department. No costs.
