Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus, directing the respondents 1, 3 and 5 to take appropriate action by considering the petitioner's representation letter, dated 27.11.2025 and to direct the respondents to remove the drainage canal laid in the petitioner's patta land Survey Nos.233/3A and 206/3B2B situated at Vettavalam Town Panchayat, Kilpennathur Taluk, Tiruvannamalai District and provide alternative drainage pathway, restore the petitioner's land to its original condition within a time frame. ORDER

This Writ Petition is filed to direct the respondent Nos.1, 3 and 5 to remove the drainage canal laid in the petitioner's patta land, more fully disclosed in the prayer to this Writ Petition, based on the petitioner's representation, dated 27.11.2025 within the time to be fixed by this Court.

2. According to the petitioner, in the year 2020, in the petitioner's patta land, more fully disclosed in the prayer to this Writ Petition, the respondents had laid a drainage canal. According to the petitioner, the said drainage canal caused inconvenience to the petitioner. In such circumstances, the petitioner had given a representation on 27.11.2025 to the respondent Nos.1, 3 and 5 requesting them to remove the drainage canal from the petitioner's patta land, more fully disclosed in the prayer to this Writ Petition. Since the said representation was not considered, the petitioner has filed this Writ Petition.

3. Mr.M.Shahjahan, learned Special Government Pleader takes notice for the respondent Nos.1, 2, 6 to 8. Mr.P.Gurunathan, learned Additional Government Pleader (Civil Side) takes notice on behalf of the respondent Nos.3 and 5.

No prejudice will be caused to the respondents if the petitioner's representation, dated 27.11.2025, as stated supra, is considered on merits and in accordance with law within the time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner's representation.

For the foregoing reasons, this Writ Petition is disposed of by directing the third respondent to pass final orders on merits and in accordance with law on the petitioner's representation, dated 27.11.2025 seeking for removal of the drainage canal laid in the petitioner's patta land, more fully disclosed in the prayer to this Writ Petition, within a period of 12 weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
