O R D E R

This petition has been filed to modify the condition imposed by the learned Principal Sessions Judge, Dharmapuri in Crl.M.P.No.1203 of 2016 dated 20.07.2016.

2. Heard the learned counsel for the petitioner; learned Additional Public Prosecutor appearing for the respondent and perused the materials placed on record.

3. The petitioner is an accused in Crime No.226 of 2016 for offences under Section 294[b], 324, 447, 427 and 506[ii] IPC and was granted anticipatory bail in Crl.M.P.No.1203 of 2016 on 20.07.2016 by the learned Principal Sessions Judge, Dharmapuri, on condition that he should deposit a sum of Rs.50,000/- to the satisfaction of the Judicial Magistrate No.1, Dharmapuri, subject to certain other conditions. Aggrieved by the condition of deposit of Rs.50,000/-, the petitioner is before this Court.

4. The petitioner is aggrieved with the condition of asking him to deposit Rs.50,000/- on the ground that the victim had not suffered any serious injury.

5. Taking into consideration the facts and circumstances of the case, this Court is of the view that it will serve the interest of justice, if the condition of deposit reduced to Rs.10,000/- and accordingly, this petition for modification is ordered. Rest of the conditions imposed by the Sessions Judge shall remain the same. Two weeks time is extended from the date of receipt of a copy of this order for furnishing sureties and depositing the amount.
