O R D E R
[Made by S.M.SUBRAMANIAM, J.,] The show cause notices dated 06.03.2026 issued under Section 128(1)(b)(ii) of the Tamil Nadu Urban Local Bodies Act, 1998 (Act 9 of 1999) [hereinafter "TNULB Act" for the sake of convenience and clarity] are under challenge in the present writ petitions.
2. Admittedly, the petitioners have submitted their representations in response to the show cause notices. Thus, the petitioners are required to await the final decision to be taken by the competent authorities after due consideration of the representations already submitted by them. It is needless to state that the Commissioner shall take a final decision and pass appropriate orders and thereafter proceed with enforcement action, if any encroachments are identified.
3. If the petitioners are aggrieved by the final decision of the Commissioner, it is open to them to prefer appeals in the manner known to law. It is made clear that the respondents shall strictly follow the procedure Page Nos.3/6
as contemplated under the TNULB Act and Rules framed thereunder. With the above observations, the Writ Petitions stand dismissed. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
