ORDER
This writ petition has been filed to direct the respondents to implement the order of this Court dated 30.07.2025 in W.P.No.28164 of 2025 in letter and full spirit and also to direct the respondents to take control over the Temple and take charge of administration, immovable and moveable properties and scrutinize the Temple records according to the procedure embodied under law. 2.The petitioner states that she is a devotee of Arulmigu Veeramatchi Amman Temple situated at Periya Negamam Village, Pollachi Taluk, Coimbatore District. The Temple is owning several properties and earning income through various sources.
It is the contention of the petitioner that the Village Head, who is in administration of the Temple, along with others, has misappropriated the Temple accounts and therefore, the petitioner made a representation in this regard before the District Collector on 18.03.2022. Pursuant to the same, the jurisdictional Inspector of HR & CE Department inspected the Temple and conducted enquiry and filed a report confirming the mismanagement with a recommendation to bring the Temple under the control of HR & CE Department. Despite the said recommendation, since no steps were taken, the petitioner filed a writ petition in W.P.No.28164 of 2025 to implement the recommendation to bring the Temple under the control of HR & CE Department. This Court, by order dated 30.07.2025 in W.P.No.
2025, directed the 1st respondent to take a final decision within a period of eight weeks from the date of receipt of a copy of the order. However, it is the grievance of the petitioner that, despite issuance of such direction, the respondents are not taking any steps to implement the orders of this Court dated 30.07.2025 in W.P.No.28164 of 2025. Hence, the petitioner has come forward with this writ petition.
3.Learned counsel for the petitioner would submit that, even though contempt notice was also issued on 10.02.2026 to the respondents, they have not come forward to implement the orders of this Court. Rather, they informed the petitioner that a Fit Person has been appointed for the administration of the Temple. The learned counsel would submit that the order of this Court has not been complied with in letter and spirit and hence, seeks for appropriate orders. 4.At the outset, this Court is of the view that the prayer in this writ petition is misconceived. If the petitioner is aggrieved over the nonimplementation of the orders of this Court, the remedy available to her is to file a Contempt Petition before this Court, but not a writ petition seeking mandamus to implement the earlier order of this Court. Therefore, the writ petition is not maintainable. Accordingly, this writ petition is dismissed. No costs. 06-04-2026 Index: Yes/No Speaking/Non-speaking order NHS
