ORDER
(Order of the Court was made by M.M.SUNDRESH, J.) Praying to issue a writ of mandamus forbearing the first respondent from proceeding with further actions in pursuance of the sale auction notice dated 23/06/2020 to sell the property belonged to petitioner at SF No.392/IDI in Verapandi Village, Nallur Sub-Registration District, Thiruppur District measuring https://hcservices.ecourts.gov.in/hcservices/
an extent of 0.44 acres till the disposal of S.A.SR No. 4262/2020 on the file of Debts Recovery Tribunal at Coimbatore, the present writ petition has been filed.
2. Challenging the very same proceedings, the petitioner is stated to have filed an application in S.A.SR No. 4262 of 2020 before the Debts Recovery Tribunal, Coimbatore, which is yet to be numbered.
3. In such view of the matter, no further orders are required to be passed in this writ petition. The Debts Recovery Tribunal, Coimbatore is directed to number S.A.SR No. 4262 of 2020 and hear the same on merits within a period of one week from the date of receipt of a copy of this order, if the papers are otherwise in order.
4. With the above direction, the writ petition stands closed. No costs. Consequently, the connected miscellaneous petition is closed.
