O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing the respondent to consider the representation made by the petitioner.

2. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

3. The specific case of the petitioner is that the land measuring an extent of 0.54 cents in Thiruvallur District, Avadi Circle, Vellanoor Village bearing Survey No.311/20 originally belonged to his late father, viz., Munusamy Reddiyar. The revenue records including SLR and 'A' Register reflected the name of his father and patta No.452 was also granted in the name of his father. Subsequently, the petitioner was allotted the subject land by his father by virtue of oral partition. While reviewing the revenue records, it was found that the patta for the subject land has been mutated in

the name of one Rasambal, who according to the petitioner is a complete stranger and has no right, title or interest over the subject land. The petitioner has thus submitted a representation dated 25.08.2023 to the respondent seeking modification and rectification of the patta in his name. Since the same was not considered, the present writ petition has been filed.

At the outset, it was submitted by learned Government Advocate for respondent that the representation dated 25.08.2023, made by petitioner would be considered and appropriate orders would be passed within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.

In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the respondent, to consider the representation dated 25.08.2023 on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of

hearing to the petitioner, Rasambal and any other interested persons, within a period of twelve weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any view with regard to the merits of the case and it is open to the respondent to consider the representation on its own merits and in accordance with law.
