Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of certiorarified mandamus to call for the records of the 2nd respondent relating to Pro.No.T1/57206/2000 dated 2.9.2002, quash the same and to consequently include the petitioner's name in the panel for the year 1999-2000 for promotion as Forest Ranger in the appropriate year and in the appropriate place and promote him as such with retrospective effect from the date of promotion of his immediate junior with consequential benefits.

ORDER

This writ petition came on transfer from the Tribunal (O.A.No.6599 of 2002).

2. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Forests) appearing for the respondents. https://hcservices.ecourts.gov.in/hcservices/

3. The petitioner suffered punishment of stoppage of increment for one year without cumulative effect imposed by the Principal Chief Conservator of Forests, Chennai in proceedings in Pro.No.T1/57206/2000 dated 2.9.2002 based on the enquiry findings holding that part of Charge I and all parts of Charge II had been proved and in respect of Charge III, the acceptance of bribe is not proved, but, the charge of demand deemed to have been proved against the petitioner.

4. After filing of O.A., the petitioner also filed an appeal, during the pendency of the O.A., which has been transferred as writ petition, the appeal was taken on file and the same was dismissed vide order in G.O.Ms.No.3(D) dated 16.4.2013 whereby the order imposing punishment of stoppage of increment for one year without cumulative effect stood confirmed.

5. Unfortunately, the petitioner did not challenge the order in appeal passed in G.O. Ms.No.18 dated 16.4.2013. Therefore, the writ petition stands dismissed. No costs.
